Foster City man who hit dad with hammer gets 9 months

A Foster City man who hit his father in the head with a hammer because he mistakenly thought the 81-year-old man had to be hospitalized before he could be admitted to a nursing home has been sentenced to nine months in jail.
Jayantibhai Patel, 58, could have been sentenced to five years in state prison after pleading no contest in August to elder abuse.
But at a hearing Friday in Redwood City, Judge Clifford Cretan of San Mateo County Superior Court ordered Patel to serve the shorter sentence in county jail. Patel is to surrender Jan. 10.
The judge, who declined a defense request for home detention, also placed Patel on three years of probation and ordered him not to harass his father and to attend counseling sessions for domestic batterers for a year.
Patel, who also admitted to causing great bodily injury, was originally charged with attempted murder in the October 2007 incident.
