Elder Abuse Litigations: The New Cash Cow for Many

Elder Abuse: The New Cash Cow for Many
By Andrew C

It is a disturbing development in recent years that many, including lawyers, guardians and even some judges are involved in “stripping” assets from the elderly.

How can this happen in well-developed countries with well-informed and intelligent populace; can only astound the rest of the world.

I have been given information about a case involving different jurisdictions and country. The case involved a charge of Financial Elder Abuse of a deceased man.
This is a serious charge. If that was a false charge then a great injustice has been done to the accused.

The litigations involved siblings and span a lengthy period of time and are still ongoing.

I wonder if the lawyers involved in this case are just as enthusiastic, in pursuing this case, if there were no assets or money available for “milking”.

What happen to lawyers who dishonestly issued false affidavits?

How can ordinary citizens fight such battles, knowing that lawyers have the obvious advantage when it comes to legal matters?

If we suggest that the accused get legal representation, then are we not falling into the trap of assisting the lawyers to milk the cash cow – Elder Abuse litigations or, Estate litigations.

This case sets off a warning for all of us who are thinking of making a will.

Perhaps, we should put a clause in our will stating that if our children disputed the will, then all assets will go to a charity.

On the other hand, if the charges were true, that is, if elder abuse was genuinely proven, then the person charged, must pay!
