Sisters Found Guilty of Elder Neglect (USA)

Barry sisters found guilty of elder neglect

By KATE THAYER

A judge told two Geneva sisters Thursday that their “good intentions” didn’t excuse the condition of their mother in the months before her death.

In that ruling, Jill and Julie Barry, 55 and 48, were convicted on one count each of criminal neglect of an elderly person – a Class 3 felony – in the April 2007 death of their 84-year-old mother Mary Virginia Barry.

Associate Judge Allen Anderson handed down his ruling Thursday morning – about two months after the conclusion of a bench trial that began in April and spanned four days throughout the spring.

The Barrys are scheduled to be sentenced Oct. 9. They could receive probation, or could be sentenced to between two and five years in prison.
Mary Virginia Barry died April 27, 2007, after a week-long stay at Delnor Hospital in Geneva. When she arrived, she was covered in bed sores and her own urine and feces, according to trial testimony.

Associate Judge Allen Anderson handed down his ruling Thursday morning.

State’s Attorney John Barsanti, who tried the case, said he hopes Anderson’s ruling might pave the way for awareness and clarification for elder abuse and neglect laws in Illinois.
