Woman Gets Four Years in Elder Abuse Case (Canada)

Woman gets four years in elder abuse case

Elderly mother developed gangrene and died after spending months confined to a chair in a filthy Moncton apartment

By OLIVER MOORE

April 15, 2009

A Moncton woman whose elderly mother developed gangrene and died of heart failure after literally rotting for months on a chair in a filthy apartment has been sentenced to four years in prison.

Canadian advocates for the elderly say they have never heard of a harsher sentence, and that society is starting to treat such abuse with the gravity it deserves. But they also fear that more cases of mistreatment and exploitation will be seen in the current economic downturn.

Calling the case "reprehensible," Judge Sivret rejected the defence lawyer's urging for a conditional sentence and imposed a penalty harsher than the 30 to 36 months Mr. Deschenes had called for.

"I cannot begin to imagine the pain and suffering that Kathleen Grant endured prior to her admission at the hospital," she wrote in a decision released yesterday. "... It is difficult to imagine a situation in which the gravity of the offence to provide necessaries of life would be higher than the one presented in this case."
